Home and Boat Italy reserves the possibility to modify the present selling terms and conditions at any time. In case of modification, the selling terms and conditions in effect the day of the order will be applied to every order.
Home and Boat Italy only guarantees the indicated prices and the availability of the items while quantities last. During its treatment, you will receive a confirmation e-mail itemizing your order, with the final prices; Home and Boat Italy reserves the right to modify the indicated prices without advance notice.
We reminds you that the operation in relation with the authorization given by the bank serves for validating your order and for verifying the validity of your card.
From de receipt of your order, we verify the availability of ordered product(s). In case of unavailability, we make a commitment, within 30 days from the date of the order, either to deliver you the ordered product, or to pay you off in case of definitive unavailability.
If one of the ordered items is out of stock, we send the remaining of your order and we inform you by e-mail of the approximate date of availability of the missing product(s).
Validation of the orders
To conclude the purchase agreement of one or several products on Home and boat Online shop, you have to fill the electronic order form, by following the relative instructions.
Any order form the consumer sign by “double-click” constitutes an irrevocable acceptance which can be questioned only within the limits established in the present selling terms and conditions.
The “double-click” associated with the procedure of authentification and non-renunciation, and with the protection of the integrity of messages, constitutes an electronic signature. This electronic signature is, for the two parties, tantamount to the handwritten signature.
The indicated prices are all taxes included (after I.V.A), except the contribution to processing and shipping costs.
Home and Boat Italy reserves the right to modify its prices at any time but makes a commitment to apply the current prices which will have been indicated to you at the time of your order, subject to availability at this date.

You can make the payment :
– By credit card directly
The payment is made on the secure banking servers of UNICREDIT Bank. This implies that no banking information concerning you passes through the website “Home and Boat Italy”. The payment by credit card is thus perfectly secured; your order will so be recorded and validated as soon as the bank accepts your payment.
For payments by credit card directly, the information of your credit card are encrypted thanks to the SSL protocol (Secure Socket Layer) and never passes trough the network unencrypted. The payment is directly made with our bank.
Title retention clause
Products remain the property of Home and Boat Italy until the collection of the order. However, the risks concerning the delivered products are transferred to the customer as from the delivery.
Home and Boat Italy reserves the right to refuse to make a delivery or to honor an order coming from a consumer with whom a dispute would be in process.
Modalities of delivery and delivery time
Products are delivered to the delivery address which you indicated us during the process of order.
All the announced deadlines are calculated in working days. The indicated deadlines are average deadlines and correspond to the time of treatment, preparation and shipping of your order (left warehouse). To this time, it is necessary to add the delivery time of the carrier (SDA – Poste Italiane).
The overtaking of the shipping time can give rise to a cancellation of the order since the order has not left our warehouses. For that purpose, you only have to contact us.
For an order consisted of several items, the shipping time of this order is then based on the longest shipping time. Home and Boat Italy reserves the possibility to split the order in several deliveries, without supplementary cost for the customer.
Any available article in stock is sent within 7 days (left warehouse).
In all other cases, the availability can vary between 11 and 30 days according to the type of ordered products.
The ordered products are delivered by the mail circuit or by the independent carrier, and to the exclusive initiative of Home and Boat Italy, to the address appearing on the order form.
From the parcel to the Delivery
You have to check the correspondence of the goods delivered at the time of the delivery and before signing the delivery order of the carrier.
You have to indicate on the delivery order and under form of handwritten reserves with your signature any anomaly concerning the delivery (damaged product). This check is considered as made since the buyer, or the person having his authorization, signed the delivery order.
You will also have to indicate the anomalies by registered mail and to confirm your reserves to the carrier at the latest within the 3 working days following the reception of the article(s) and to pass on a copy of this mail to:

If the products require to be sent back to us, they have to be the object of a request of return with our Customer services within 7 days following the delivery. Any complaint formulated outside this deadline cannot be accepted. The return of the item can be accepted only for products in their original state (packaging, accessories).
If at the time of the delivery, the original packing is damaged, torn, opened, you then have to check the condition of articles. If they were damaged, you necessarily have to refuse the parcel and write down a reserve on the delivery note (refused parcel because opened or damaged).
The shipping date being evidence
It is the time included between the date of confirmation of the order and the date of scanning which testify that the parcel left our warehouses.
- During the final validation of your order, we confirm you its average shipping time. It corresponds to the longest deadline of the order.
- An email of your order shipping confirmation mention this date and indicates you a delivery deadline.
Home and Boat Italy would not be blamed for the non-fulfilment of the concluded contract because of force majeure, disturbance or all-out/partial strike in particular for postal services and means of transportation andor communications medium, of flood, fire. The choice and the purchase of a product are placed under the only responsibility of the customer. The impossibility to use the products in particular because of incompatibility can give rise to no compensation, repayment or questioning of Home and Boat Italy responsibility, except in the case of proven latent defect, nonconformity, imperfection or exercise of the right of retraction mentioned at article 8.
In case of nondelivery of an order or part of an order, you have one month maximum (as from the date of departure from our warehouses) to manifest yourselves. Beyond this deadline, we shall accept no complaint.
Right of retraction
According to the Consumer Code, the consumer has a 7 working days period as from the delivery date of his order, to send back any article not being suitable for him, and ask for the exchange or the repayment without penalty, except the return costs.
The product will necessarily have to be sent back in perfect state, undamaged, unworn, in its original packing.
Or else you will lose your right of retraction and the product will be sent back to you to your expenses.
Return costs for retraction
The return costs in case of retraction remain chargeable to the customer. To assure the follow-up to your parcel, please choose to send back via UPS or follow-up Colissimo.

- 7 days in the case of a retraction as from the reception of your parcel to warn us of your wish to send back the product in its original packing and in good condition (unworn). The date being evidence is the one of the e-mail of information sent by the customer, and that we get through the address email@example.com, to inform us about his wish to exercise his right of retraction.
- 7 days to indicate us an imperfection or nonconformity of your product. The date being evidence is the one of the e-mail of information sent by the customer, and that we get through the address firstname.lastname@example.org, to inform us about an imperfection or nonconformity of the product.
Any worn article can be subjected to no return for nonconformity.
From reception of the agreement, you have 15 days to send us back the product. After this deadline, your return will be refused.
If you send us back the parcel, we decline any responsibility in case this one would not reach us. The responsibility of the parcel remains chargeable to the sender.
We make a commitment to refund you the price of the product by bank check or transfer depending on our choice within maximum one month as from the reception of the parcel and that if all the procedures of return were correctly made.
All the return costs to send back the parcel to our warehouses are chargeable to the buyers. Except in case of error from us during the order, to which case we shall take care of the return costs of the products.
